1. Who we are
1.1 These terms govern the property review service ("the Service") provided under the name Condo Verdict ("I", "me", "we") by Sakda Phoomphan, an individual, TODO, Thailand. E-commerce registration number: TODO. Contact: [email protected].
1.2 You must be at least 18 years old to order the Service. By ordering, you confirm that you are.
2. What the Service is
2.1 The Service is an independent written analysis of one or more condominium units you are considering buying, delivered as a PDF report ("Report"). I cover only condominium units in the Thong Lo, Phloen Chit and Chit Lom areas of Bangkok. I do not cover land, houses, commercial property, or ownership structures such as companies or trusts. Leasehold condominium units are covered; lease terms, remaining term and renewal are listed as questions for your own lawyer.
2.2 Depending on the package you buy, a Report may include: a comparison of the asking price with other asking prices (an "asking-price comparison"); an estimate of purchase and running costs; rental income scenarios; a list of ownership, legal and tax questions you should raise with your own lawyer; project and location observations; negotiation suggestions; and a next-steps checklist.
2.3 Package contents, page ranges and prices are those shown on the website at the time you pay. I keep a record of each version of the pricing page.
3. What the Service is not
3.1 The Report is an analysis aid. It is NOT:
- (a) legal advice. I am not a lawyer. Where a Report lists legal points, they are questions for you to raise with a licensed Thai lawyer, not conclusions. You must consult a licensed Thai lawyer on any legal question, including ownership, foreign quota, contracts, title, and tax;
- (b) a valuation or appraisal by a licensed valuer. The asking-price comparison is not a statement of value;
- (c) tax advice;
- (d) investment, financial or brokerage advice, or a recommendation to buy or not buy;
- (e) a guarantee of any price, rental income, yield, occupancy, resale value or outcome.
3.2 I do not act as an agent or broker for you or for any seller, and I do not negotiate on your behalf.
4. Information and limits
4.1 Thailand has no complete, reliable public database of actual sale prices. Reports rely on asking prices, information you provide, information published by third parties, and stated assumptions. Each key figure is given a confidence rating.
4.2 I do not independently verify documents or information you or third parties provide (including listings on third-party websites) unless the Report says so. If information is incomplete, outdated or wrong, the Report may be wrong.
4.3 Laws, fees, taxes and regulations change. Each Report states the date its rates and rules were checked. I am not obliged to update a Report after delivery.
4.4 I use software tools, including AI tools, to help collect, organise and draft Report content. I review every Report and make the verdict and risk judgements myself. By submitting the intake form, you agree that the information and documents you provide may be processed with these tools, as described in the Privacy Policy.
5. Ordering, payment and delivery
5.1 You order by paying through Stripe. Before paying you must accept these terms. Prices are shown in USD. Your card issuer may apply currency conversion or fees.
5.2 After payment you will be asked to complete an intake form.
5.3 "Start Time" means the moment I have received a complete intake form, meaning all required fields and documents for your package. The delivery period (48 consecutive hours, including weekends and public holidays, measured in Bangkok time, UTC+7) starts at the Start Time, not at payment.
5.4 If the intake form is incomplete, I will tell you what is missing within one business day (a business day is Monday to Friday, excluding Thai public holidays). The Start Time is then the moment I receive the missing items.
5.5 If you do not submit a complete intake form within 30 days of payment, I may close the order and refund your payment in full.
5.6 I may decline an order (for example, a property type or area I don't cover, or a conflict of interest) and refund your payment in full.
5.7 If you have a problem with the Service, please contact me before starting a dispute with your card issuer, so I can resolve it quickly. This does not limit your rights.
6. Refunds
Refunds are governed by the Refund Policy, which forms part of these terms.
7. Your responsibilities
7.1 You confirm the information you provide is accurate to the best of your knowledge and that you have the right to share any documents you upload.
7.2 Please remove or black out passport numbers, national ID numbers, bank account numbers and similar identifiers from documents before you upload them. I do not need them.
7.3 You are responsible for your purchase decision and for obtaining independent legal, tax and financial advice before you sign or pay anything.
8. Independence and conflicts of interest
8.1 I do not sell property and do not accept commission from sellers, developers or agents in connection with properties I review.
8.2 I currently receive no referral fees. If I ever receive a referral fee from a lawyer or other service provider mentioned in a Report, I will disclose it in that Report.
8.3 If I recommend or mention a lawyer or other provider, I am not responsible for their services, and you contract with them directly.
9. Confidentiality
I keep your information, documents and Report confidential and use them only to provide the Service, except where disclosure is required by law or to the service providers listed in the Privacy Policy.
10. Intellectual property and use of the Report
10.1 The Report is for your personal use in deciding on your purchase. You may share it with your family, lawyer, accountant, lender or adviser. You may not resell or publish it.
10.2 You keep ownership of the documents you provide. I keep the right to reuse my general methods, templates and anonymised, non-identifying data.
11. Liability
11.1 To the extent permitted by law, if the Report contains an error caused by me, my total liability to you is limited to the amount you paid for that Report.
11.2 To the extent permitted by law, I am not liable for loss arising from your decision to buy, not buy, rent, sell or negotiate a property, from the accuracy of information supplied by you or third parties, or from the outcome of any price, rent, yield or resale assumption, including loss of profit, loss of opportunity or loss of value.
11.3 Nothing in these terms limits liability that cannot be limited by law, including liability for fraud, intentional misconduct or gross negligence.
12. Events beyond my control
I am not liable for delay or failure caused by events beyond my reasonable control (for example illness, power or internet failure, platform outages, natural disaster, or government action). I will tell you promptly, and you may ask for a refund if the delay exceeds 7 days.
13. Privacy
How I handle your personal data is described in the Privacy Policy.
14. Changes
I may update these terms. The version in force when you pay applies to your order.
15. Governing law
These terms are governed by the laws of Thailand. This does not take away any mandatory consumer rights you have under the law of the country where you live.
